2. Undang-Undang

Law No. 13-89 Foreign Trade

Undang-undang ini mengatur ekspor dan impor barang dan jasa berdasarkan batasan yang ditentukan oleh undang-undang inii maupun regulasi lain dalam hal menjaga keamanan, keselamatan, kesehatan dan lingkungan hidup. Regulasi ini juga bertujuan untuk melindungi industri dalam negeri dari ancaman masuknya produk-produk impor yang tidak terkontrol. Tindakan pengamanan produk nasional akan dilakukan oleh pemerintah ketiga importasi dinilai sudah mengancam maupun menyebabkan kerugian yang serius terhadap keberlangsung produksi nasional. Adapun bentuk tindakan pengamanan yang dilakukan, yaitu bea masuk imbalan, bea masuk antidumping, tindakan tarif dan non-tarif dan tambahan bea masuk.

Law No. 31-08 Enacting Consumer Protection Measures.

Undang-undang ini bertujuan memastikan informasi yang jelas, objektif dan adil bagi konsumen (harga, pelabelan, ketentuan penjualan), memperkuat perlindungan ekonomi konsumen (larangan atau praktik komersial tertentu), menyeimbangkan kembali hubungan konsumen-produsen(larangan klausul yang tidak adil, jaminan, kredit), memperkuat gerakan konsumen dengan mengakui asosiasi perlindungan konsumen sebagai lembaga publik yang berwenang mengambil tindakan hukum. Peraturan ini juga menjami hak-hak konsumen terpenuhi seperti hak atas informasi, hak untuk memilik, hak penarikan, hak untuk mendengarkan dan mewakili dan hak atas perlindungan kepentingan ekonomi.

Kementerian terkait menyedikan portal https://www.khidmat-almostahlik.ma/portal/fr yang dapat dimanfaatkan oleh konsumen dalam rangka diseminasi tentang perlindungan konsumen (peraturan, kegiatan/event dan informasi lainnya) dan wadah untuk meminta informasi maupun menyampaikan pengaduan terkait perlindungan konsumen.

Law No. 24-09 Safety of Products and Services.

Undang-undang ini mengamanatkan bahwa setiap produsen dan importir serta penyedia jasa wajib menyediakan produk (barang/jasa) yang aman untuk dikonsumsi oleh konsumen. Dalam menilai keamanan produk, yang perlu diperhatikan sebagai berikut :

karakteristik produk (komposisi, kemasan, kondisi perakitannya, instalasi, penggunaan, pemeliharaan)
pengaruh produk terhdap produk lain
penyajian produk, pelabelan, peringatan dan instruksi produk, pembuanganan produk
kategori pengguna yang berisiko akibat penggunaan produk
informasi lainnya yang berkaitan dengan produk

Undang-undang Standardisasi, Sertifikasi dan Akreditasi.

Standar Maroko disusun, disetujui, direvisi dan diterapkan sesuai dengan kondisi yang ditetapkan dalam undang-undang ini dan ketentuan untuk penerapannya.
Sertifikasi adalah tindakan sertifikasi, untuk menetapkan bahwa suatu produk, layanan, sistem manajemen, proses, materi atau kompetensi orang perseorangan di bidang tertentu sesuai dengan standar Maroko yang disetujui atau standar yang diakui atau diadopsi sesuai dengan ketentuan undang-undang ini.
Akreditasi adalah pengakuan formal, oleh administrasi, kompetensi lembaga penilaian kesesuaian untuk menerbitkan tanda, sertifikat atau label, atau laporan tentang analisis, pengujian, kalibrasi, dll.

3. Regulasi

Verifikasi Kesesuaian (Verification of Conformity -VOC)

Decree No. 02-212-502 dan Order No. 3873-13. Konvensi untuk penyediaan layanan verifikasi/inspeksi kesesuaian produk industri yang diimpor ke Maroko.

Inspeksi perlu dilakukan baik di negara ekspor (pre-shipment) atau di wilayah Maroko (Destination Inspection) – tergantung pada kategori produk yang diatur.

Regulasi Penandaan dan Pelabelan Cم (CMIM).

Penandaan dan instruksi penggunaan dalam bahasa Arab untuk produk konsumen, dan penandaan CMMIM wajib untuk produk listrik, sesuai dengan Order no.2573-14 (keamanan listrik), 2574-14 (Kompatibilitas Elektromagnetik), dan 3228-13 (penandaan).

Produsen dan importir wajib memenuhi persyaratan pelabelan yang telah ditetapkan untuk setiap produk yang dipasarkan di Maroko.

Berikut logo tanda "Cم".

Saat menempelkan tanda Cم pada produk, beberapa hal yang harus dipatuhi sebagai berikut :

Penandaan produk harus ditampilkan dengan jelas, terbaca, dan tidak mudah terhapus pada permukaan produk
Penandaan harus menyertakan inisial (C) dan (م) dan mematuhi ketentuan bentuk, tampilan, dan penyajian yang ditetapkan dalam peraturan teknis khusus.
Tidak ada penandaan lain yang boleh memengaruhi visibilitas, keterbacaan, atau makna tanda Cم (CMIM)
Dimensi vertikal inisial huruf “C” tidak boleh kurang dari 6 mm.
Logo harus ditampilkan pada permukaan produk. Jika sifat produk tidak memungkinkan, tanda Cم (CMIM) dapat dicantumkan pada kemasan dan dokumen yang menyertainya.

Sebagai informasi, tidak semua peralatan listrik dan elektronik harus mematuhi peraturan tanda Cم, berikut daftar produk yang masuk daftar pengecualian dalam penggunaan tanda Cم.

Catatan.

Setelah diperoleh persetujuan tanda CMIM, tidak perlu diperpanjang selama dua kondisi berikut terpenuhi:

Perusahaan (misalnya produsen) memiliki sarana dan kontrol yang sesuai untuk memastikan kesesuaian yang berkelanjutan dengan regulasi yang berlaku.
Regulasi yang relevan mengizinkannya dan tidak menyatakan sebaliknya.

Regulasi Persetujuan Perangkat Telekominikasi (ANTR radio type approval)

Peralatan telekomunikasi dan instalasi radio harus mendapatkan persetujuan dari The Agence Nationale de Réglementation des Télecommunications (ANRT). ANRT menggunakan standar EN berdasarkan Radio Equipment Directive (RED) 2014/53/EU, yang menetapkan persyaratan untuk kesehatan dan keselamatan, EMC, dan penggunaan frekuensi radio.

Pelabelan adalah wajib dan harus dilakukan sesuai dengan ANRT/DG/N°12/04 untuk semua peralatan terminal atau instalasi radio yang diimpor dan disetujui.

Setiap peralatan terminal atau instalasi radio yang disetujui harus, sebelum komersialisasi, diberi label dengan tag yang tidak dapat dilepas, sesuai dengan ANRT / DG / N ° 12/04.

Catatan.

Peralatan apa pun yang dijual kepada publik dan tidak diberi label dengan benar dianggap tidak sah.

Pembatasan Zat/Bahan Berbahaya

Restriction of Hazardous Substances (RoHS)

Regulasi RoHS Maroko mengacu pada Directive 2002/95/EC, pedoman untuk membatasi penggunaan zat berbahaya (misalnya logam berat) pada peralatan listrik dan elektronik. Eksportir maupun importir harus memastikan bahwa produknya tidak mengandung zat terlarang di atas ambang batas yang telah ditentukan.

Berikut zat berbahaya yang masuk dalam pembatasan:

Sertifikasi RoHS adalah janji produsen / pemasok produk kepada konsumen bahwa produk mereka dibuat sesuai dengan Directive RoHS serta menetapkan spesifikasi untuk mendaur ulang limbah produk listrik dan elektronik.

Regulasi Pengawasan Pasar

Pengawasan pasar adalah instrumen mendasar untuk menerapkan ketentuan pada Law No. 24-09 tentang keamanan produk dan layanan untuk memastikan perlindungan konsumen dari risiko yang terkait dengan penggunaan produk industri yang tersedia di pasar nasional, selain produk pertanian dan farmasi.

Kerangka regulasi pengawasan pasar produk mesin listrik antara lain:

Décret n° 2-12-502 of 2 Rejeb 1434 (13 May 2013) made for the purposes of the first title of Law No. 24-09 on the safety of products and services and supplementing the Decree of 9 Ramadan 1331 (12 August 1913) forming code of Obligations and Contracts.
Ministerial Order No. 6404-15 of 1st of Moharram 1437 (15 October 2015) related to electrical equipment destined to be used under certain limit of tension.
Ministerial Order No. 6404-15 of 29 Ramadan 1436 (16 July 2015) related to the electromagnetic compatibility of equipment.
