1.1 Manajemen Perdagngan Luar Negeri.

Law No. 05/2017/QH14 on Foreign Trade Management

Undang-undang ini mengatur langkah-langkah untuk tata kelola perdagangan luar negeri, pengembangan kegiatan perdagangan luar negeri dan penyelesaian sengketa tentang penerapan langkah-langkah tata kelola perdagangan luar negeri. Kegiatan perdagangan luar negeri mencakup ekspor dan impor, impor sementara untuk diekspor kembali, ekspor sementara untuk diimpor kembali, transfer lintas batas dan transit, dan kegiatan lain yang terkait dengan pembelian dan penjualan barang internasional sesuai dengan hukum serta perjanjian yang ditandatangani oleh Republik Sosialis Vietnam.

1.2 Mutu Produk dan Barang.

Law No. 05/2007/QH12 on Product and Goods Quality

Undang-undang ini mengatur tentang hak dan kewajiban organisasi maupun perseorangan yang memproduksi atau memperdagangkan produk atau barang serta organisasi dan individu yang melakukan kegiatan yang berkaitan dengan mutu produk dan barang dan tata kelola mutu produk dan barang.

1.3 Standar dan Regulasi Teknis.

Law No. 68/2006/QH11 on Standards and Technical Regulations

Undang-undang ini mengatur tentang perumusan, penerbitan dan penerapan standar, perumusan, pengundangan dan penerapan regulasi teknis, dan penilaian kesesuaian dengan standar dan regulasi teknis. System standar di Viet Nam terdiri dari standar nasional (TCVN) dan standar perusahaan (TCCS). Sedangkan, system regulasi teknis di Viet Nam terdiri dari regulasi teknis nasional (QCVN) dan regulasi teknis local (QCDP).

1.4 Perlindungan Hak Konsumen.

Law No. 59/2010/QH12 on Protection of Consumer’s Right

Undang-undang ini mengatur tentang hak dan kewajiban konsumen, kewajiban organisasi atau perorangan yang memperdagangkan barang dan/atau jasa kepada konsumen, kewajiban organisasi sosial dalam melindungi kepentingan konsumen, penyelesaian sengketa antara konsumen dengan organisasi atau individu yang memperdagangkan barang dan/atau jasa.

2.1 Manajemen Mutu Produk Kelompok-2.

Circular No. 48/2011/TT-BCT on quality management of group 2 products and goods. Sirkular ini mengatur produk kelompok-2 di bawah pengelolaan Kementerian Perindustrian dan Perdagangan Vietnam, antara lain:

• Jaminan Mutu:
  • Jaminan mutu produk di bidang manufaktur.
  • Jaminan mutu produk impor.
  • Jaminan mutu produk saat diedarkan.
  • Jaminan mutu produk dalam penggunaan/pemanfaatan.
• Pengumuman kesesuaian dengan peraturan teknis:
  • Importir/Produsen harus mengumumkan kesesuaian produk dengan peraturan teknis terkait.

Circular No. 35/2011/TT-BGTVT on procedures for granting Certificate of technical safety quality of loading and unloading equipment, boilers, pressure equipment used in transport.

Pengaturan sertifikasi keamanan teknis untuk peralatan bongkar muat, boiler, dan peralatan bertekanan pada sektor transportasi. Circular ini memuat measures mengenai:

• Impor peralatan bongkar muat, boiler dan peralatan tekanan untuk digunakan dalam transportasi memerlukan sertifikat untuk penilaian desain
• Mengatur prosedur penerbitan sertifikat untuk penilaian desain peralatan bongkar muat, boiler dan peralatan tekanan yang diimpor untuk digunakan dalam transportasi

2.6 Regulasi Impor Mesin dan Peralatan Bekas Pakai.

Circular No. 23/2015/TT-BKHCN on import of used machinery, equipment and technological lines.

Circular ini mengatur kriteria, dokumen dan prosedur untuk mengimpor mesin, peralatan dan jalur teknologi bekas, termasuk komponen bekas, suku cadang dan suku cadang  dengan Kode HS Bab 84 dan 85 yang ditentukan dalam Daftar ekspor dan impor Vietnam yang diumumkan oleh Kementerian Keuangan.

Surat Edaran ini tidak berlaku untuk impor mesin, peralatan dan jalur teknologi bekas sebagai berikut:

• Transit; pemindahan perbatasan;
• Impor sementara untuk diekspor kembali (kecuali untuk impor sementara untuk diekspor kembali untuk pelaksanaan kontrak pemrosesan; dalam hal impor untuk produksi atau konstruksi untuk melaksanakan proyek investasi); ekspor sementara untuk diimpor kembali;
• Melakukan kontrak layanan perbaikan dan pemeliharaan dengan luar negeri;
• Menerima transfer domestik dari perusahaan di zona pemrosesan ekspor, perusahaan pemrosesan ekspor (bukan di zona pemrosesan ekspor); antara perusahaan di zona pemrosesan ekspor;
